Agreement to Terms
By accessing or using FableSense AI ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service. These Terms apply to all visitors, users, and others who access or use the Service.
Description of Service
FableSense AI is a mixed-methods research platform that provides:
- Qualitative data analysis and coding tools
- Quantitative data visualization and analysis
- AI-powered insights and pattern detection
- Joint display creation for mixed-methods research
- Collaboration features for research teams
- Data export and reporting capabilities
User Accounts
When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms.
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.
You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
You may not use as a username the name of another person or entity that is not lawfully available for use, or a name or trademark that is subject to any rights of another person or entity without appropriate authorization.
Acceptable Use
You agree not to use the Service to:
- Upload or transmit viruses, malware, or other malicious code
- Attempt to gain unauthorized access to our systems or other users' accounts
- Use the Service for any illegal purpose or in violation of any laws
- Harass, abuse, or harm another person
- Impersonate any person or entity
- Interfere with or disrupt the Service or servers
- Circumvent any rate limits or access restrictions
- Scrape, data mine, or extract data from the Service without permission
- Use the Service to process data that you do not have the right to use
- Violate the intellectual property rights of others
Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of FableSense AI and its licensors. The Service is protected by copyright, trademark, and other laws.
Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of FableSense AI.
User Content
You retain all rights to any content you upload, post, or otherwise make available through the Service ("User Content"). By uploading User Content, you grant us a limited license to store, process, and display your content as necessary to provide the Service.
You represent and warrant that you have all necessary rights to upload your User Content and that it does not violate any third-party rights.
We do not claim ownership of your research data. Your data remains your property, and you may export or delete it at any time.
Subscription and Payment
Some features of the Service require a paid subscription. By subscribing to a paid plan, you agree to pay the applicable fees.
Billing: Subscriptions are billed in advance on a monthly or annual basis depending on the plan you select.
Automatic Renewal: Your subscription will automatically renew unless you cancel it before the renewal date.
Refunds: Refunds are handled on a case-by-case basis. Contact our support team if you believe you are entitled to a refund.
Price Changes: We reserve the right to modify our pricing. Any price changes will be communicated in advance and will take effect at the start of your next billing cycle.
Limitation of Liability
In no event shall FableSense AI, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.
Our total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
The Service is provided on an "as is" and "as available" basis without any warranties of any kind.
Disclaimer
Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied.
We do not warrant that the Service will be uninterrupted, timely, secure, or error-free. AI-powered features are provided for assistance only and should not replace professional judgment in research contexts.
Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms.
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may do so by contacting us or using the account deletion feature in your settings.
Your data will be available for export for 30 days following termination, after which it will be permanently deleted.
Governing Law
These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which FableSense AI operates, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
